Request for Public Records (FOIA)

OverviewRequests for public records are fulfilled under the guidelines of the Illinois Freedom of Information Act (5 ILCS 140). The Deputy City Clerk is the appointed Freedom of Information Act Officer (FOIA) for the City of Elmhurst. You may contact the FOIA Officer at (630) 530-3015 or by emailing foia@elmhurst.org for more information. The Freedom of Information Act Officer is located in the Administration Office of City Hall, 209 N. York St., Elmhurst, IL 60126.
How to Request a RecordAll requests must be submitted in writing to the attention of the Freedom of Information Act Officer. Applicants may use the City of Elmhurst’s suggested online form or the FOIA Request Form(PDF) or may submit their own written request for records. Applicants choosing not to use the provided form please provide the following:

  • full name
  • current address
  • phone number
  • a detailed account of the documents they are requesting and whether or not they are requesting the documents for commercial use.
Written requests may be submitted in person at the Administration Office at City Hall, mailed to the attention of the Freedom of Information Act Officer or emailed to foia@elmhurst.org. For more information call (630) 530-3015.

Requestors will be contacted within the time allotted by law with a response to their request (5-business days or 21-business days for commercial requests, 1 additional day allowed for Federal holidays); at that time the requester will be told of any fees associated with their request.

It is a violation of the Freedom of Information Act(5 ILCS 140/3.1) (c) for a person to knowingly obtain a public record for a commercial purpose without disclosing that it is for a commercial purpose if requested to do so by the public body.
Certified DocumentsFor an additional charge documents may be certified. Certified documents have a signed and sealed letter from the City Clerk stating that the attached documents are true and correct copies of the original documents on file with the City of Elmhurst.

The Clerk’s Office advises those needing public records for legal proceedings to have their documents certified.

Please note that the requester will be notified if any records they have requested need to be sent out for reproduction/printing. The requester will be charged at cost for said reproductions/printing jobs.
